1. 重要性を増す法律問題

最近、法律相談が増えています。
従業員から、不当解雇、サービス残業、パワハラ・セクハラの主張を受けた。発注元から契約書が送られてきたが、これでよいかどうかわからない。消費者からクレームが来たが、対応方法がわからない。法律問題の特徴は、法律を知らなければ正しい対処ができないけれども、法律を理解することが難しいということです。
日本では、一年間に約 130 件の法律が定められ、これ以外に多数の裁判例が公表されています。余程の大企業であれば、法務部で対応可能でしょうが、普通の企業で、これらに対応することは不可能です。

2. 顧問弁護士を持つ良さについて

弁護士に顧問料を支払うことは、無駄でしょうか。答えは、どんな顧問弁護士を頼むかによります。顧問料を支払うだけで、相談したこともないような弁護士では役に立ちません。しかし、いざというときのために、信頼できる弁護士を確保して、ちょっとした相談も気軽にできることは、厳しい判断を迫られる経営者にとって重要です。また、継続的な相談により会社の背景事情を理解した上で助言する方が、弁護士としてもより的確な回答が可能になります。

3. 当事務所との顧問契約をプラスにしていただくために

1. Increasing Importance of Legal Issues

In recent years, a growing number of corporate operators have been seeking legal advice. Some need to deal with various complaints of their employees, such as unfair dismissal, unpaid overwork and power or sexual harassment, and others are not confident of how to handle a written agreement received from parties placing orders, or how to deal with complaints from consumers. A particular aspect of legal issues is the fact that you cannot properly handle them without knowledge of laws; however, understanding laws is difficult. In Japan, about 130 laws are stipulated a year, and, in addition, many court cases are disclosed. It is generally impossible for companies to handle all those rules, except for very large-scale enterprises having their own legal department.

2. Advantage of Having a Legal Advisor

Is it a waste of money to pay a legal fee to a lawyer? The answer is, “it depends on what kind of legal advisor the company selects.” It is useless to have a lawyer that you only pay a legal fee to and never consult. It should be also noted that the scope of area that a single lawyer is able to handle is limited (same as doctors).
Having a reliable lawyer is essential because you may need one in an emergency. It is important for corporate managers who have to make tough decisions to be able to freely consult with a legal professional. Further, misunderstanding is inevitable in personal communications. Continuously keeping in contact with your legal advisor will help him or her to understand the details of your company’s state, and, as a result, provide more appropriate responses.

3. In Order to Get the Most of Our Consultancy Agreement

We strive to protect the legitimate benefits of our clients to the maximum extent. We wish to be your companion who overcomes difficulties with you, instead of being like a traditional lawyer who provides conventional services. We do not provide short-term advantages to our clients but give advice from the viewpoint of looking to offer them benefits in the long term.

First, make a comparison with other legal offices; and if you find that the culture and management philosophy of your company matches our standpoint, you may wish to consider signing a consultancy agreement with us. Conversely, if your intention is to find loopholes in laws or continue to pursue short-term interests, we regret to say that you should select another office because we would not be the right advisor for you.
